WARRANTY, TERMS, & CONDITIONS

Effective January 1, 2009
Although we strive to ensure the excellence and quality of our products offered, we reserve the right to correct or update any of our policies without notice.  Unless otherwise indicated, Can Do Mechanical offers one (1) Year Labor & Workmanship Warranty on all residential and six (6) months for commercial applications.
The Basic Labor & Workmanship warranty coverage applies ONLY to original purchaser.   
Can Do Mechanical reserves the right to void labor and workmanship warranty coverage in the event anyone other then Can Do Mechanical employees assesses, tampers, or otherwise works on equipment during the first year of coverage. 
TERMS & CONDITIONS OF SALE for Customers Extended Credit.
We charge interest of 1-1/2% per month on past due balances. 
TITLE OF GOODS
The physical risk in the Parts & Equipment provided by Can Do Mechanical shall pass on to the buyer upon completion of installation.  Parts & Equipment remain the property of Can Do Mechanical until paid in full. 
Warranty or Workmanship issues or claims are not in effect unless paid to terms.  We reserve the right to void any warranty when payment terms are not met. 
DELIVERY
Any dates quoted for delivery/ arrival of Parts & Equipment are approximate only and Can Do Mechanical shall not be liable for any delay in the delivery of the Parts & Equipment howsoever caused. 
DAMAGE & LOSS
Responsibility for delivery to the destination in good condition rests with Can Do Mechanical, Inc.  Physical damage or malfunction resulting from fire, water, storm, earthquake, theft, riot, misuse, improper selection or misapplication of equipment is not covered under our warranty.  CDM shall not be responsible for such loss or damage. 
OWNER’S RESPONSIBILITY
  1. To Check and Change filters as necessary.
  2. To check switches, replace fuses, or reset circuit breakers.
  3. To operate the equipment in accordance with the manufacturers instructions.
  4. Have chimney inspected and approved by certified chimney professional.
  5. To perform all routine maintenance and special maintenance as listed in owner’s manual.  Can Do Mechanical reserves the right to deny any claim due to failure to have the equipment serviced by a Can Do Mechanical Technician (or authorized substitute) on a bi-annual basis.
  6. Provide Can Do Mechanical free access to the equipment and controls.  Any work required to gain access to equipment will be subject to labor charges. 
WHAT’S NOT COVERED
  1. Damage or malfunction resulting from fire, water, storm, earthquake, theft, riot, misuse, improper selection or misapplication of equipment.
  2. Routine Maintenance or repairs that are made necessary because routine maintenance was not performed.
  3. Repairs to alter the listed equipment to meet changes in Federal, State, or Local codes or regulations.
  4. Works performed by other then Can Do Mechanical technicians.
  5. Freight Charges.
  6. Increase in utility costs or related expenses.
  7. Excess utility costs as a result of malfunctioning equipment.
  8. Damage resulting from use in a corrosive environment.
  9. Chimney related problems. 
LIMIT OF LIABILITY
  1. Can Do Mechanical shall not be held liable for costs related to manufacturer breakdowns, recalls, service letters, and/ or operational claims or characteristics.
  2. Can Do Mechanical shall not be responsible for excess energy usage (gas, oil, or electric) as a result of malfunctioning equipment, misuse of equipment, and/ or building structural concerns or lack of modern insulation, etc.
  3. Can Do Mechanical shall not be held liable for chimney related problems, issues, or concerns.
  4. Can Do Mechanical shall not be held liable for any damage and/ or injury as a result of chimney related problems.
